This treaty creates a pathway similar to other entrepreneur-based residence options, enabling Japanese citizens to:

•   Work as self-employed professionals; 

•   Establish commercial activities with fewer barriers than standard immigration routes.

Who Can Benefit from the Treaty? 

The Dutch-Japanese Trade Treaty is primarily designed for: 

•   Japanese nationals starting a business in the Netherlands; 

•   Independent entrepreneurs, such as freelancers (ZZP) or business owners (e.g., eenmanszaak, BV, etc.). 

Japanese nationals currently residing in the Netherlands under a different permit may also explore this treaty as a pathway when transitioning to entrepreneurship or independent work, subject to IND assessment. 

Compared to standard Dutch immigration routes for self-employed individuals, the treaty often offers more accessible entry conditions. 

Legal Requirements for Residence Under the Treaty

Typical requirements include: 

1. Japanese Nationality 

Applicants must hold Japanese citizenship to qualify under the treaty. 

2. Business or Self-Employment Activity 

You must establish or operate a business in the Netherlands or work as a self-employed professional. This can include: 

•   Freelance or consulting services; 

•   Trading businesses;

3. Business Registration 

Your business must be registered with the Dutch Chamber of Commerce (KvK). Proper registration is a critical legal step in the process.

To showcase the operational value, entrepreneurs must make a minimum investment in their Dutch business, depending on the type of company: 

•   Eenmanszaak (sole proprietorship): €4,500

•   Vennootschap onder firma (general partnership): at least 25% of the paid-in capital, minimum €4,500

•   Besloten vennootschap (private limited company): at least 25% of the paid-in capital, minimum €4,500

•   Naamloze vennootschap (public limited company): at least 25% of the paid-in capital; since the minimum capital is €45,000, the minimum investment is €11,250

As of April 1, 2024, the IND allows Japanese Trade Treaty visa applicants to receive initial approval without submitting KvK registration, balance sheets, or business bank statements upfront, but may verify business registration and the €4,500 investment within six months of approval

This investment demonstrates a genuine commitment to establishing and operating a business in the Netherlands, which is a key condition for eligibility under the treaty. 

5. Compliance with Dutch Immigration Rules 

Applicants must meet the general conditions set by the Immigration and Naturalisation Service (IND), including:
